Mi Drone Terms of Service
Before using Mi Drone series products (hereinafter referred to as “the Products”), please read through and understand all rights and restrictions as specified in User’s Agreement (hereinafter referred to as “this Agreement”) carefully.
Xiaomi Science and Technology Co., Ltd. and its associated companies (hereinafter refers to as “Xiaomi” or “We”) always respect and strictly protect users’ legitimate rights and interests (including user privacy and user data) from being infringed in any way or by any means when they use the Products.
The Products shall include, but not limited to, Mi Drone (including Mi Drone software operating system, mobile device software application named “Mi Drone" and Mi Drone cloud service, etc.) and relevant products that are developed by Xiaomi. Xiaomi shall reserve the relevant intellectual properties of the Products (including all copyrights, patent rights and trademark rights of the Products).
This Agreement (including the privacy policies in the last part hereof) shall be the final, complete and exclusive agreement by and between the user (including the natural person, legal person or other organization that acquire the Products through all legal ways possible, hereinafter referred to as “the user” or “You”) and Xiaomi regarding the matters related to the Products and shall replace and merge all discussions and agreements by and between Xiaomi and the user with regard to the matters mentioned herein previously.
This Agreement legally binds on the user’s behavior of using the Products. You have committed and guaranteed to have the rights and ability to conclude this Agreement. The user shall be regarded as having accepted this Agreement as long as he/she starts to use the Products (the privacy policies in the last part of this Agreement will further specify the privacy policies agreed by the user). Please read through and understand all terms stated herein, including exceptions that exempt and restrict Xiaomi’s responsibilities and user’s right limitation (the juveniles shall be accompanied by their legal guardians when reviewing this Agreement). If you cannot accept all terms and conditions stated herein, please do not use the Products. (Where the user has purchased our hardware products but cannot accept all terms and conditions herein, the user may, as appropriate, return the hardware of the Products by inquiring relevant policies at http://www.mi.com).http://www.mi.com）
1 Use
1.1 Account
To use Mi Drone APP, you can register a Xiaomi account (note: APP supports third-party login, such as facebook; this sentence will be deleted in main text) by providing your relevant personal information at registration page (including the state/region, your name, e-mail, mobile phone number, etc.). You shall commit and warrant:
1.1.1 You are above the age of 18 and all the registration information submitted by you are real and accurate;
1.1.2 You use Mi Drone in a legal way;
1.1.3 You can terminate your account at all times according to the Xiaomi account operating instructions.
Xiaomi will reserve or terminate your account as per the provisions of Article 5 hereof.You shall warrant holding your login information in strict confidence, never allowing any third party to acquire or use such information and holding liable for all your behaviors under the website account. You must inform Xiaomi, within the shortest time possible, of the behaviors that may break the laws, the unauthorized use or use suspected to be unauthorized. You may bear legal liabilities for the loss caused if failing to abide by the requirements above.
2 Terminal User Agreement
2.1 License
In accordance with the provisions of this Agreement, Xiaomi will grant you the following non-transferable and exclusive license:
2.1.1 The right to use the Products;
2.1.2 The right to download, install and use the Products in network communication processes.
2.2 Restrictive terms
Your authorization may be restricted in the following aspects according to the provisions of this Agreement:
2.2.1 It is not allowed to sub-license, sell, lease, transfer, release or use the Products for other commercial purposes in any form;
2.2.2 It is not allowed to modify, translate, reorganize, combine, use, decompose, transform or decompile any part of the Products or derivative products, unless otherwise such restrictions are allowed as per laws;
2.2.3 It is not allowed to use the Products for the purpose of dealing with business identical to or competitive against ours;
2.2.4 Unless otherwise expressly prescribed by law, it is not allowed to produce, duplicate, release, sell, download or display any part of the Products in any way or by any means;
2.2.5 It is not allowed to delete or destroy any copyright statement or other ownership mark contained in the Products.
2.3 Attribution of rights
2.3.1 The user is allowed to use and download the Products;
2.3.2 Xiaomi (as well as its “authorizer”, if any) owns all the relevant intellectual properties of the Products.
2.4 Fees
The user shall bear the fees for purchasing the Products as well as relevant fees such as communication fees and information fees generated from personal online surfing or charged by a third party (including but not limited to the telecom or mobile communication provider).
2.5 Any updated version or future version of the Products as well as the update or other changes of the version shall be restricted by this Agreement.
3 User’s Contents
3.1 User’s contents
3.1.1 User’s contents refer to all contents released by users or generated when the user uses the Products in other ways (including your flight record, photos and videos, text information, data, audio, etc.).
3.1.2 You are the unique responsible person of your user content who shall bear the risks that you or any third party may be recognized and relevant legal liabilities by the disclosure of your user contents.
3.1.3 You have agreed that your user contents are restrained as per Article 4.
3.2 Feedback
3.2.1 Your suggestions (or also called “feedback”) will be considered as your agreement on the transfer of all “feedback” rights to Xiaomi and your agreement on Xiaomi’s use of such feedback and relevant information through any reasonable way. We will handle the feedback as unclassified and non-exclusive information;
3.2.2 You have agreed not to provide Xiaomi with any information that you believe is exclusive;
3.3 We may reserve the rights to check the contents shared by user based on our judgment (not our obligations).
Whether you receive our notice or not, we shall have the rights to delete and move the contents shared by the user at all times with any cause. According to the provisions of Article 5, we shall have the rights to reserve or terminate your account.
4 Right Restrictions and Obligations
4.1 You have agreed to use the relevant services of the Products by sharing or through any other ways. While using the services, you shall undertake all legal liabilities incurred by the risks caused by the following behaviors:
4.1.1 Using the services for any illegal purpose or by going against any local, state, national or international laws;
4.1.2 Infringing upon or encouraging others to infringe upon any right of the third party, including infringing upon or embezzling any third party's intellectual property or infringing upon any third party’s privacy right;
4.1.3 Interfering with service safety-related functions, including (a) functions that prohibit or avoid the use or duplication of any contents; (b) reverse engineering or attempt to find the source code of any part of service through other ways, unless the activity is allowed as per the explicit regulations of laws;
4.1.4 Interfering with the operation of service or any user’s enjoyment of services, including (a) uploading or transmitting via any other ways any virus, advertisement software, spyware, worm or other malicious code; (b) making any non-invitation offer or advertisement to other users of the services; (c) attempting to collect the personal information of the other user or any third party without acquiring prior consent; (d) interfering with or interrupting any network, equipment or server connected with or used for service provision or going against any regulations, policies or programs of such networks, equipment or servers;
4.1.5 Executing any fraud activity related to the services obtained or used by the user, including simulating any individual or entity, claiming any spurious association or visiting the account of Xiaomi’s other companies or the third party account granted to Xiaomi or simulating your age or date of birth;
4.1.6 Selling, or transferring in other ways the access right conferred according to this term or any material or any flight environment data, or any right and ability to view access, use any material or flight environment data.
4.2 You have agreed not to be engaged in any of the following behaviors with the Products:
4.2.1 Releasing or sharing computer virus, worm, malicious code, or the software intentionally destroying or changing computer or data software;
4.2.2 Collecting other user’s information or data without authorization, such as e-mail address;
4.2.3 Using the Products maliciously and automatically, causing excessive burden to server or causing interference or damage to website server and network links through any other ways;
4.2.4 Attempting to visit the server data or communication data of the Products without being authorized;
4.2.5 Acquiring, selling or providing citizen's personal information or data (including image and video) without being authorized;
4.2.6 Interfering with or destroying other users from using the Products.
5 Modification and Termination
5.1 Modification
5.1.1 It is not allowed to change the contents of this Agreement arbitrarily; Xiaomi reserves the rights to change the contents herein from time to time; for any substantial change regarding this Agreement, we may send a notice to users by the announcement of the Products. The user is considered as having agreed with the changed terms while continue to use the products after the change.
5.1.2 Xiaomi shall reserve the rights to modify, reserve or close any service of the Products at all times without sending a prior notice.
5.1.3 The user has agreed that Xiaomi does not shoulder any liabilities for the user or any third party due to the modification, reservation or closing of any service of the Products.
5.2 Termination
5.2.1 This Agreement shall come into effect upon your acceptance and remains valid while the user uses the Products until it expires;
5.2.2 otwithstanding the foregoing, if the user uses the Products earlier than the time when accepting this Agreement, the user hereby acknowledges and agrees that this Agreement becomes valid as long as the user uses the products for the very first time, unless it is terminated in advance as per this Agreement;
5.2.3 Xiaomi may, （1）eserve the user’s rights to use the Products or the account of the website as per the provisions of laws;（2）erminate this Agreement at any time for whatever reason, whether sending a notice or not, including Xiaomi believes in good faith that the user breaks Xiaomi’s policies or other regulations of this Agreement;
5.2.4 Notwithstanding the foregoing, if the user infringes upon the copyright or any other legitimate rights and interests of a third party and Xiaomi has received the notice of the obligee or such obligee’s agent, Xiaomi will reserve the rights to terminate this Agreement;
5.2.5 Once this Agreement is terminated, the user's right to use the Products also expires and Xiaomi then will delete all user’s contents accordingly. The user shall know and agree that the termination of rights to use the Products means the user’s contents will be deleted from the Xiaomi’s active database. Xiaomi will not bear any liability for the termination of this Agreement, including terminating your user’s account and deleting your user’s contents.
6 Third Party
6.1 The user has already known or agreed that part of Xiaomi’s service is obtained based on the third-party technical support, such as Apple iOS and Google Android. The user has known that this Agreement is signed by and between the user and Xiaomi, rather than the aforesaid third party. Xiaomi shall serve as the exclusive responsible party for the contents, maintenance, support service and guarantee as well as lawsuit arising out of the Products. The user has agreed to abide by and accept the authorization of using the services of the Products conditionally.
6.2 Third-party information and services
6.2.1 The Products have included the third party’s some information and services, for which, Xiaomi does not control or hold liable.
6.2.2 Xiaomi will provide such information and services for the convenience of use or for committing and guaranteeing the third party’s demand.
6.2.3 The user shall instead bear legal liabilities for the risks arising out of the use of such information and services.
6.2.4 The user’s access to the third party’s information and services shall be governed by the third party’s terms and policies.
6.3 Other users
6.3.1 The Products may contain the user’s contents provided by other users. Neither Xiaomi nor the Products control or bear legal liabilities for the user’s contents. Xiaomi is not obliged to check, monitor, approve, verify, promise or guarantee the user’s contents. The user therefore shall bear legal liabilities for the risks arising out of using the user’s contents or interacting with other users.
6.3.2 While using the Products, the user may collect, process or use other’s personal information, such as name, image and geographic position. Should such circumstance happens, the user shall abide by the relevant legal liabilities for personally processing the information, including but not limited to notice, applying for approval, confidentiality and safety protection.
6.3.3 Xiaomi does not bear any legal liabilities for the user’s interaction with others, which shall instead be the behavior of the parties concerned. The user has agreed that Xiaomi does not bear any legal liabilities for the user’s interaction.
7 Compensation
7.1 The user has agreed to use the Products properly so as to hold Xiaomi harmless from any complaint, lawsuit, loss, damage, responsibilities, costs and expenses (including attorney fees) brought by any third party due to the following or relevant behavior:
7.1.1 The user’s behavior of using the Products;
7.1.2 User’s contents;
7.1.3 The user’s behavior against this Agreement.
7.2 Xiaomi shall reserve the right of exclusive defense and right to ask for compensation.
7.3 The user has agreed, unless otherwise agreed by Xiaomi in writing, not to choose unilateral reconciliation in the lawsuit filed jointly by Xiaomi and the user against any third party.
7.4 Xiaomi will inform the user of such kind of lawsuit, acts in action or proceeding with all reasonable efforts.
7.5 Under no circumstance will Xiaomi shoulder damage compensation liabilities for any indirect, consequential, disciplinary, occasional, special or punitive damage compensation arising out of this Agreement of the user or any third party. The user has to bear computer system damage or mobile communication equipment database risks arising out of accessing or using the Products.
8 Disclaimer
8.1 Xiaomi bears no any legal liabilities in any of the following circumstances:
8.1.1 User’s personal information is provided according to laws and regulations or at the request of relevant government organs;
8.1.2 The user discloses any personal information due to improper use;
8.1.3 The user’s requirements cannot be satisfied due to service interruption or disruption caused by hacker attack, invasion of computer virus, illegal information, shielding of harassment information, government control or any other network, technique, communication line and information security management measures;
8.1.4 The user's loss caused by the fault of communication line, technical problems, network and computer fault and system instability of the third party such as operator and other force majeure;
8.1.5 The user suffers any risk caused by the information from anyone anonymous or personator that contains threatening, slanderous, repulsive or illegal contents after using the Products;
8.1.6 Xiaomi explicitly declare in writing that it will not guarantee the timeliness, security and accuracy of the Products or the services provided by its cooperated companies in an expressed or implied manner, or in any other form.
9 Privacy Policies
“Privacy policies of the Products” shall serve as part of this Agreement and legally binds on the user. The user can review this part at the last part of this agreement. Xiaomi hereby kindly reminds the user to read carefully and understand all the contents stated in privacy policies.
10 Notices
10.1 The user must provide valid e-mail address that is used frequently in the latest time in Xiaomi account. We bear no liabilities for your risks caused by the failure of using the e-mail address provided by the user or our failure of notifying the user for whatever reason.
10.2 The announcements as well as e-mail containing such kinds of notices as released by Xiaomi undoubtedly constitute the valid notices.
11 Applicable Laws
11.1 This Agreement is restricted by the local laws where the user uses the Products.
11.2 Any dispute arising out of the performance of this Agreement shall be resolved by both parties via negotiation; in case of failure of negotiation, both parties agree to accept the individual and exclusive jurisdiction of the local court. Xiaomi does not mean that the services or any material or flight environment data contained in services are applicable to or suitable for your location.
12 Exclusiveness
In case some terms in this Agreement become no longer applicable due to any reasons, other terms shall continue to be applicable. Those inapplicable terms shall be modified to be legally applicable.
13 Integrity
13.1 本This Agreement (including privacy policies) is the final, complete and exclusive agreement regarding the matters related to the Products between Xiaomi and the user and shall replace and combine both parties’ all previous discussions and agreements regarding the matters above (including the previous final user license, service terms and privacy policies).
13.2 The title of each part is for the convenience of reading only and does not constitute any lawful or contractual obligations.
13.3 Unless otherwise agreed by Xiaomi in writing, the user is not allowed to transfer any right or obligation as specified herein and the attempt of transfer that break the regulations is invalid.
Privacy Policies
The user can use our service through different ways, such as purchasing Mi Drone hardware products by logging in Xiaomi’s official website, using Mi Drone hardware products and services at different terminals. We are able to provide better service as long as the user shares information (such as by creating a Xiaomi account), such as displaying the product update and advertisement with higher relevance degree, assisting the user contacting others or sharing contents with others easier and more quickly. On the basis of the above, we will interpret our way to collect and use the information to the user as well as the way the user may use to protect their privacy right. The user is considered as having agreed the above by action as long as he/she registers a Xiaomi account, provides us with relevant information (including personal and non-personal information), visits our website or uses our products and service, clicks relevant confirm button or through other ways which can be rationally understood as your agreement,that is, you accept and agree the privacy policies and agree that the Xiaomi can collect, save, process, disclose, share and use your personal information and other non-personal information as per the privacy policies.
Our privacy policies shall include the issues in the following several aspects:
Information collected by Xiaomi;
How do we collect and use the information;
How the user provides the information optionally and how to visit and update the information;
Information sharing, transfer and security, scope of application of privacy policies, collection and use of children’s personal information and revision of privacy policies;
Conventions of special product service.
Information collected by Xiaomi
Xiaomi generally collects two kinds of user’s information: personal information (data related to the special natural person and able to recognize the natural person either independently or through the combination with other information) and non-personal information (data except for personal information). Should Xiaomi link and combine non-personal information and personal information through technical means, the information will be personal information within the period when it is linked and combined.
How we collect and use the information
When the user interacts with Xiaomi and its associated companies (hereinafter collectively known as “Xiaomi”) and its operation cooperators (including but not limited to the user’s purchase of our products and services at store, visiting our website, social platform, social network, mobile application software and participating in our various kinds of activities), the user may be inquired if agreeing on providing his/her some personal information required for using our basic product service. Such personal information may be combined with other information and used for improving our products or services. We will collect, process and use the user’s personal information by human or by automatic data processing (including using database, cloud arrangement and big data algorithm).
Below are some examples on the types of personal information that may be collected by us and how we use the information.
While the user creates a Xiaomi account, downloads and updates Xiaomi software, makes a registration at Xiaomi online retailing store, participates in online investigation, files a complaint to Xiaomi or involves in other interactions with Xiaomi,，mi may require you to provide personal information, including but not limited to your Xiaomi ID, profile photo, personalized signature, name, occupation, gender, date of birth, ID card No., MP, postal code, area code, e-mail, mailing address, income and property, health status and consumption.
While the user purchases Xiaomi products and services, ，Xiaomi will collect relevant personal information, including but not limited to delivery details, bank account, details of credit card, bill address, credit investigation and other financial information and record of contact and communication.
While the user synchronizes Mi Drone data,your flight record data will be transmitted to and saved in the server.
While the user shares your contents with family and friends, sends information and product or invites others in Xiaomi forum by Mille products,Xiaomi may collect the personal information related to the personnel above provided by the user, such as name, mailing address, e-mail and MP. Before providing the information to Xiaomi, the user shall acquire the consent of relevant personnel. In case of any legal dispute arising out of Xiaomi’s provision of the personal information of the personnel above, the user then shall bear the corresponding legal liabilities.
While the user visits Xiaomi server, our server will record some log information automatically, which may include the followings: IP address, browser type and language, refer source page, operating system, data/time stamp and click stream data.
While the user uses position information-based program service or function, Xiaomi may collect the information about your geographic position. For instance, when the user uses the flight track information recorded by Mi Drone, explores based on the position, uses position-based ads or uses position to optimize weather conditions or acquires map information, your position information may be sent back to Xiaomi so that Xiaomi can provide the correct contents to you.
While the user joins in Xiaomi’s “user experience improvement plan”, we will record the use of all product functions in an anonymous manner so as to collect the user’s relevant information about the habit to use Xiaomi's official website, products and service. If the system exits abnormally or crashes, we will collect the mobile phone’s current environment information for the sake of problem diagnosis.
Xiaomi will strictly abide by the privacy policies and the updated contents contained to use your personal information. The user’s personal information will only be used for the purpose having been determined in course of collection and agreed by the user. For any other purpose except for the above, Xiaomi will remind the user in advance to acquire the user’s agreement as per the provisions of the privacy policy or other ways.
The user’s personal information collected by us may be used for providing user with Xiaomi’s products and services, processing your order or performing the contract by and between the user and Xiaomi or establishing and managing your Xiaomi accountso as to ensure the function and safety of our products and services, verify the user’s identity and therefore avoid and investigate fraud or other improper use circumstances.
The user’s personal information collected by us may be used for providing the user with information and services,such as displaying the user’s flight record information to the user.
The user’s personal information collected by us may be used for our products and services development, operating, appraising and improving our business (including developing new products and services, enhancing and improving our service, managing communication, analyzing products; data analysis and executing accounting, audit and other internal functions),even though we use comprehensive and statistical information only for the purpose only under general circumstances.
The user’s personal information collected by us may be used for the communication with you,for instance, sending a notice to the user as soon as Xiaomi product or service is updated or released; if the user refuses it, Xiaomi will stop sending any commercial information.
The user’s personal information collected by us may be used for personalized design of productsand providing considerate service, such as recommending and displaying the contents and ads designed for the user specially in our service or using it for investigation.
As long as the user participates in the lottery, contest, program, questionnaire or similar promotion activities held by Xiaomi, Xiaomi can use the personal information provided by the user for managing and promoting such kind of activities.
Your Mi Drone hardware recognition code and geographic position information (the geographic position information is mainly used for providing the user with proper local service) may be used for activating your warranty service and special software license and the user may also be invited to the investigation.We may also use the information for improving our products and analyzing the efficiency of our business operation but we will never use it for tracking your position.
We may obtain statistical data by analyzing Xiaomi’s “user experience improvement plan” to keep improving the operation experience and operation performance of products and services, fixing problems and improving functional design.
We may, on the basis of laws and regulations, relevant industrial criteria and our policies, collect and use the user’s personal information.
We may, on the basis of other legal purposes related to Xiaomi products or service, collect and use the user’s personal information.
We may use the user’s personal information via other ways informed while collecting such information.
In order to operate and improve our technique and service, we may collect your non-personal information with a view to providing the users with better user experience and improving our service quality.
Below are some examples on the non-personal information that we may collect and on how we use the information.
Language and time zone information——While the user creates Xiaomi account, downloads and updates Xiaomi, makes registration at Xiaomi mobile phone online retailing store, participates in online investigation or other interactions with Xiaomi, we may collect your such information as language and the time zone where the user uses Xiaomi products.
Mobile phone information——While the user uses Mi Drone application program, to judge if it is supported by mobile phone, we need to acquire your mobile phone operating system and its version and mobile brand and model.
Information collected by Cookies and other technique——Xiaomi website, online service, interactive application software, e-mail news and ads publicity may make cookies and other techniques such as pixel tag and web beacons collect and save the user’s non-personal information.
Equipment information——While the user uses and activates Mi Drone hardware, the unique recognition code of the hardware equipment, firmware version and general geographic position information (non-personal information) will be sent to the server. The collection of the aforesaid information may also apply to your system or software update or factory reset.
Debugging log information——While the user assists us analyzing problems by uploading debugging log, the user’s application debugging log documents will be sent to the server.
Our collection of such non-personal information as language and use of time zone where Xiaomi product iscan assist us better understanding user’s behavior and improving our products, service and ads publicity.。
The information collected by us through cookies and other technique (such as pixel tag) willbring the user with better user experience and improve our overall service quality.For instance, by saving your language preference setting, we can display our service with your premium language. We can send the user readable e-mail via pixel tag and inform us if the e-mail is opened. We can use the information for reducing or avoiding send e-mail to users.
How user provides information optionally
Everyone may have its own focus on privacy right, so we will explicitly point out the way to collect information so that the user can select the way to receive information.
The user can set if joining “user experience improvement plan” independently, that is to say, the user can exit the plan by closing the switch of “user experience improvement plan”.
The user can modify the positioning setting of the equipment through equipment setting, such as changing or prohibiting positioning method or positioning server or modifying the accuracy of your position information in order to change the position information provided to us.
The user can modify the settings of browser based on his/her own demand to refuse or accept cookies or delete it from the storage equipment at all times or receives a notice when it is written in cookies.
The user can delete position tracking information based on the demand (such as using the flight information recorded by Mi Drone track log) and the server will delete the information after it is deleted by the user.
Part or all of our service operation is finished in China while the personal information and data of foreign users will be saved in the US. No matter where you are, you agree us to transfer, process and save your personal data in China and collect and use it as per Xiaomi's privacy policies.
Visit and update of personal information
After logging in the account by clicking https://account.mi.com the user is able to visit and update his/her personal information or the user can also delete some of his/her personal information or ask us to delete your personal account, unless we must reserve these information for the sake of legal cause.
Whenever you use our service, we will try our best to enable you to get access your personal information. If the information is wrong, we will endeavor, by all ways possible, to enable you to update or delete the information quickly (except that we must reserve the information for the sake of legal business or legal cause). While updating your personal information, we may request you to verify your identity before processing your request.
Xiaomi may refuse the request that is repetitive endlessly and causes risks to other’s privacy right or extremely unpractical.
As long as we allow your access and modification to information, which costs not too much, we will provide the service freely. We endeavor to completely maintain the service to prevent information from being destroyed accidentally or maliciously. Therefore, after the user deletes information from our service, we may not delete the residual copy of the information from the in-service server immediately or delete the corresponding information in the backup system.
Sharing information with the third party
Unless otherwise limited sharing is specified in the privacy policies, Xiaomi will hold the user’s personal information in strict confidence and shall never share the user’s personal information with any third party.
The user hereby authorizes and expressly states that Xiaomi may share the user’s personal information with the third party without sending a prior notice in any of the following circumstances:
Xiaomi shares the user’s personal information with the third party due to legal investigation, lawsuit or forceful execution or other compulsory legal requirements, on the basis that Xiaomi will request the third party to keep the information secret as per the provisions of laws.
Xiaomi may provide the user’s personal information and non-personal information to its associated companies or the trustworthy data processing party or data analysis service provider or other a third party service provider that executes our service as per our requirements so as to process relevant information and provide relevant service via artificial or automatic mode, database, cloud data and/or big data algorithm for and on behalf of us. In the contract between Xiaomi and the parties above, we will regulate the corresponding terms of the privacy policies herein explicitly and request all parties to save and process the personal information by abiding by these requirements or any other applicable confidentiality and safety measures. Xiaomi will restrict the parties above from disclosing the information.
If Xiaomi involves in reconstruction or merger or Xiaomi is sold, Xiaomi may, as per the requirements of relevant business contracts, transfer the personal information collected together with the assets or business to be reconstructed, combined or sold. Prior to the transfer of all personal information collected by us, we will ensure its confidentiality according to the current privacy policies and notify all users that may be affected. We will endeavor to guide with reasonable efforts the party that will continue operating the corresponding assets or business after transaction to use your personal information by complying with the requirements of the privacy policies. Upon the occurrence of reconstruction, combination and sales, the user may inquire the matters related to information processing by contacting the party that continues operating the corresponding assets or business.
The other third party agreed by the user (for instance, our social platform may share the information collected with your friends or other users of the social platform).
We may share your information in any of the following circumstances: (i) we are obliged to share as per laws or legal procedures; (ii) we need to disclose the information to law enforcement organ or other government organs; or (iii) we believe that the information disclosed is necessary or a proper way to avoid personal injury or economic loss or for the purpose of coordinating the investigation of suspected or actual fraud or other illegal behaviors.
We may, on the basis of operating or protecting users, such as displaying the overall using trend of our products or service, share the non-personal information processed and summarized with the mass and cooperation partners reasonably.

When Xiaomi shares the user’s personal information with the third party as per the terms above, Xiaomi may transfer the personal information collected to other countries. Should they refuse to perform the confidentiality obligations, they may be subjected to the investigation of legal liabilities or requested to terminate the contractual relationship with Xiaomi.
Xiaomi attaches great importance to the security of user’s information and therefore Xiaomi works constantly to ensure the security and takes guarantee measures such as encrypting the whole storage and transmission process to prevent the user’s information from being visited, used or disclosed without being authorized. The specific contents of some encrypted data cannot be visited by anyone except the user himself/herself.
Scope of application of privacy policies
Our privacy policies are not applicable to the third party products and/or services, which may be contained in Mi Drone products and services. While the user uses the third party products or service, the third party may obtain the user’s information.。
Also, the privacy policies shall not be applicable to the external website’s data collection after the user clicks link. Our website may be connected with other websites in order to facilitate your use and acquiring of information but these websites may be operated independently and may have their own privacy notices or policies.
Therefore, we hereby remind the user to read the privacy policies of the third party but we do not make guarantee or bear liabilities for your use of the third party products or services, logging in the third party website or the third party’s acquiring, processing, use or disclosing of your personal information and its privacy policies.
Revision of privacy policies
We may change the privacy policies. We may update the privacy policies regularly without sending a prior notice in order to reflect how the policies on the protection of personal information and laws and regulations are changed. We will state the latest update date on the updated privacy policies page. We will not weaken your rights enjoyed as per the privacy policies without your consent, unless we send a notice to you via the e-mail provided by you or make an announcement on the website. The following are some special privacy conventions for your use of Xiaomi’s some products and services.
While the user uses the products, service and websites of Xiaomi account (collectively known as “Xiaomi account service”), the terms of Privacy Policies shall still govern.
Xiaomi is the provider of Xiaomi account service. The functions that can be accessed by users via Xiaomi account include but not limited to Xiaomi synchronization function and find-my-phone function. Once the user logs in Xiaomi account, we will collect your mobile phone, mobile user’s recognition information and unique recognition code of mobile equipment and will combine your non-personal information and personal information, both of which shall, while saved, be seen as personal information.
You further agree that Xiaomi may collect, use, transmit, process, disclose and maintain the information related to your account as well as the information related to any equipment or computer as registered in the account in order to provide the user with services and any function contained herein. The information collected by Xiaomi while the user uses the service also includes technical, statistical or diagnosis information arising out of or in relation with the user's use and used by Xiaomi for supporting, improving or bettering Xiaomi’s products and services.
The user may withdraw the agreement at all times by not using Xiaomi account function and logging out the Xiaomi account on your device and computer.
